Overtime

Policy Statement

Employees will be compensated with a combination of time off and pay for the performance of overtime worked in any consecutive 8 week period where the overtime is required by the Employer and approved by the Deputy Minister.

Application

This policy applies to management employees except Executive Secretaries and those management employees who regularly work and supervise other employees on rotating shifts. Where other groups of employees are covered by an authority from Treasury Board for overtime compensation different from that outlined in this policy, employees should check with their respective Human Resources Directors for more information.

Definitions

overtime  work, performed on a specific task or designated project which requires employees to work in excess of their regularly scheduled work hours, that has been approved by the Deputy Minister as necessary to the operational requirements of the Department

 

fiscal year  April 1 through March 31

Responsibility

Department

It is the responsibility of Departments to:

  • plan work processes, program delivery and staff schedules to minimize overtime;
  • make every reasonable effort to give adequate notice to employees who are required to work overtime
  • provide employees with written approval for the performance of overtime, in advance of the actual performance of that overtime;
  • establish and maintain a system of recording overtime;
  • ensure that overtime is properly managed and monitored by employee’s supervisors; and
  • submit reports of overtime worked by employees to Treasury Board as required.

Employees

It is the responsibility of employees to:

  • obtain prior approval before working overtime; and
  • identify when overtime is critical to the operation of the department.

Compensation for Overtime

Employees will be compensated for approved overtime performed in any consecutive 8 week period as outlined in the following table:

Employees who work in excess of 70 hours of approved overtime (in any consecutive 8 week period) may be compensated either with time off or pay,  at the discretion of the Deputy Minister.

Overtime payment will be reimbursed at the employee’s current salary. Where an employee is in a temporary assignment for more than 12 consecutive months, any overtime will reimbursed at the employee’s temporary assignment salary.

The maximum amount of overtime pay that employees may receive in any fiscal year is 10% of their annual salaries.

Where a Deputy Minister does not consider the overtime payment schedule outlined in this policy to be appropriate, given the work situation in the department, an alternative method of compensation may be submitted to the Treasury Board Secretariat for consideration.
